Campus Book Rentals – Textbook Rental Agreement

Background
You hereby certify that you are at least 18 years of age, that you have read the provisions of this rental agreement, and that you are renting the textbook(s) shown on the checkout page from CBR Intellectual Property, LLC, d/b/a Campus Book Rentals. You also certify that you are the account holder of the debit or credit card used for the rental transaction shown on the order or that you are an authorized user who has been given permission by the account holder to use the card. Your completion of the rental transaction constitutes your acceptance of these terms.

Condition of Books
Books rented from Campus Book Rentals are guaranteed to be correct according to your order, and in an acceptable used or new condition. Textbooks will be shipped at Campus Book Rentals discretion and depending upon supplier availability. Books may also be an instructor's version if it is determined by Campus Book Rentals that the instructor's version is identical to the student version (besides instructor comments). It is our policy to rent only US edition textbooks. Unlike many online booksellers, we guarantee our books to be US editions. Supplemental materials, such as student access codes, CD ROMs, or supplemental workbooks are not guaranteed to come with your books even if the title of the book contains language regarding CD ROMs or other forms of supplements. Although we do our very best to find books that include all their supplements, many such materials are one-time use and are not available through our suppliers in used condition. Be sure before you order that you either have access to these supplements or that you don't actually need them for your class.

Shipping
Campus Book Rentals relies on the expertise of our shipping providers which are USPS, UPS, and FedEx to get your books to you on time. Rare problems such as weather delays, rural routes, or shipping carrier system delays could affect the timing of your delivery. Campus Book Rentals will work closely with any customer that does not receive their book within the time frame selected. After a 24-48 hour processing period, please allow 7-14 business days (9-16 calendar days) for standard delivery, 5-8 business days (6-10 calendar days) for expedited delivery. Multiple items in a single order may be shipped separately from one or more locations due to varying item availability. Each individual shipment within a single order may have a separate shipping charge, but the total shipping charges for all shipments will not exceed the total amount quoted at checkout for the entire order. Should a problem arise, Campus Book Rentals will work very hard to track down the delivery problem or send out a replacement textbook at no cost to you.

Please note that we do not ship to APO, FPO, or PO Box addresses.


Ownership
Books rented from Campus Book Rentals are the property of Campus Book Rentals. At no time during the rental period does the renter obtain ownership of the books unless the renter purchases the book according to our service policy.

Communication
Campus Book Rentals will send you notifications and order receipts to the email address(es) you have provided. Campus Book Rentals may send you return notifications via email as a courtesy, but Campus Book Rentals is not responsible to notify you in any way of the return due date. You are solely responsible for returning the textbooks by the due date whether or not you receive a reminder notification from Campus Book Rentals.

I authorize Campus Book Rentals to send me emails and/or SMS text messages that include information about discounts, deals and products for today’s college students. I may unsubscribe from these communications at any time. Campus Book Rentals may use information about me, including personal information and the information I provide for my rental transaction and/or online account creation to: (1) allow me to participate in features offered or to provide related customer service, such as responding to my questions, complaints or comments; (2) customize content recommendations and offers displayed to me; (3) process a transaction I initiate; (4) provide me with information, products or services; (5) send me special offers from Campus Book Rentals, its advertisers, or its third-party business partners; (6) process my registration for rental services, including verifying my e-mail address is active and valid; (7) improve the services and for internal business purposes; (8) contact me with regard to my use of the services and, in its discretion, make changes to policies; and (9) for purposes disclosed at the time I provide my information or otherwise with my consent. Campus Book Rentals will not ask me for my personal information, account username, and password, or any of my credit or debit card information via email or text message, and I will not provide such information via email or text message. Campus Book Rentals will have no responsibility for any misuse of such information if I provide such information via email or text message.

Agreement to Return Books
You agree to return rented textbooks in a suitable bubble envelope or box to Campus Book Rentals distribution center, located in Lincoln, NE, by logging into your account and printing a prepaid shipping label on or before the last day of your rental period. Books that are not returned to the Lincoln, NE warehouse will not be cleared from your account. Please make sure you are using the Campus Book Rentals prepaid USPS shipping label to return all books. They are provided free of charge and provide both us and you definitive tracking of your books.

Books not Returned on Time
We will do our best to make returning your books simple and easy. As stated above, we even provide a prepaid shipping label you can print from your account. If however, books are not returned at the end of the rental period (and after the grace period), as specified in the rental agreement, the renter will be notified via email that their card will be charged for a 15 day extension of their book(s). If the book is not returned by the end of the 15 days the next charge will be for the purchase price of the book, which is Market Value of Book at time of Rental - (Rental Fee + Extension) = Purchase price of book. You hereby authorize Campus Book Rentals to charge your debit or credit card in the event of late or unreturned books. We work very hard to resolve every return discrepancy. After all, our wish is to keep you as a happy customer and continue to rent textbooks to you throughout your college career. The value of the textbook is determined to be the value of the book at the time it was initially rented; not the value at the time the card is charged.

Maintenance and Care of Textbooks
You, the renter, agree to keep textbooks in good, saleable condition. Campus Book Rentals is liable and responsible for the condition of rented textbooks only until they are received by the renter at the onset of the rental period. At the time of initial receipt, you, the renter, take full responsibility for the textbook. Campus Book Rentals understands normal wear and tear on a textbook. We even allow highlighting and writing within reason. Textbooks must be returned to Campus Book Rentals in good, saleable condition. If a textbook is lost, stolen, or damaged beyond saleable condition (e.g., cover ripped off, pages torn out, excessive water damage, damage that would prevent another student from reasonably being able to use and gain the full learning value from the textbook, etc.) renter will be charged the full replacement value for the textbook less the rental fee already paid, plus any applicable sales taxes.

Textbook Protection
If you select the Textbook Protection option, your account will be charged an initial, up-front fee of 16% of the rental price of your book. Should your book become lost, stolen, or damaged beyond reasonable use, for a very reasonable deductible fee of only 25% of the initial rental amount, we will either (i) promptly send you a replacement copy (if you still require the use of your book) or (ii) waive the purchase/replacement costs. When you protect your books with our Textbook Protection program, you can worry about your studies, not your books. See our Example and Terms and Conditions below.

Example
A book that rents for $55 has a value of approximately $137. If this book was not protected and needed to be replaced, the student would be charged an additional $82. With Textbook Protection however, the student would pay only the initial fee of $8.80 (equal to 16% of the rental price) plus the deductible of $13.75 (equal to 25% of the rental price) saving the student $59.45.

Terms and Conditions
Textbook Protection is not required. Books can only be protected at the time of initial rental or re-rental. Books not protected will be subject to Campus Book Rentals’ terms for replacing lost, stolen, or damaged textbooks according to this Rental Agreement. The Textbook Protection period for any covered book is for the term of the rental and grace period only. Textbook Protection will not transfer to any other book, including a replacement book, unless it is also purchased on the replacement book at time of replacement. The deductible fee of 25% of the rental price must be paid via credit card at time any Textbook Protection claim is made. Textbook Protection only covers rented textbooks against loss, theft, or damage which renders the book unusable and valueless to Campus Book Rentals. Textbook Protection claim fraud is strictly punished by law. Campus Book Rentals reserves the right to decline Textbook Protection to customers if instances of fraud or misuse are detected. Customers are encouraged to keep a copy of their receipt as it displays which books are covered. Any Textbook Protection claim must be made prior to the end of the rental term and sent via email to info@campusbookrentals.com. Please submit your order number and ISBN or title of the book you are making claim against. Claims are processed within 24-48 hours excluding weekends and major holidays.

Right to Cancel Orders
Campus Book Rentals retains the right to cancel or refuse any order that results from an error in pricing due to typographical errors, miscommunication with our partners, or any other incorrect information.

Refund and Return Policy
No hassles. No worries. Any book returned within the first 21 days after the order date will be refunded with no questions asked (shipping not included). Simply print off a return label from inside your customer account and affix to the package and send back to us! We reserve the right to refuse a refund if we see the refund policy is being abused.

Liability
Campus Book Rentals shall not be held liable for any damages incurred, physical or emotional, tangible or intangible, beyond the rental price of the textbook. Books which are lost in transit will be replaced at no extra charge; however, Campus Book Rentals shall not be held liable for poor performance in school or any other tort stemming from the rental or non receipt of your textbooks.

Rental Periods
We have structured our rental periods to fit the needs of a college student. The last thing we want is you worrying about not getting your book back to us on time. We have incorporated, at no extra charge, a grace period which allows you to rent your book early or hold on to it late in the case of a later than normal final exam. Each rental period and our grace period are discussed in detail below.
Extensions
We offer 15 and 30 day extensions if you find yourself needing to keep your book just a bit longer. Extending your rental period is easy. Simply access your account, choose the amount of time to extend, and checkout. Your account will be updated to show the new rental period.

Re-Renting
If you need to retake a class you can re-rent your book for 30% less than the original rental price. This still saves you big time over purchasing it. Simply access your account, select the "Re-Rent" button and continue the checkout process. Your account will be updated to show the new status.

Buying Your Books
If you decide you want to keep your book forever, simply access your account and select the book or books you wish to buy. Then select the "Buy and Keep My Books" button. This amount is the difference between what you already paid in rental fees and the value of the book. If you decide to purchase the book, simply complete the checkout process. Your account will be updated to show the new status.

Collections
You agree that you will not cancel or exceed the purchasing limits of the credit or debit card you provided until the rented textbooks are either returned to Campus Book Rentals or the non-return fees are paid. If the credit or debit card is declined, your account will be suspended and sent to a Third Party Collection Agency. You will be responsible for paying all Collection Fees assessed by the Third Party Collection Agency. Campus Book Rentals will make reasonable efforts to process transactions in a timely manner. You agree not to hold Campus Book Rentals responsible in the event Campus Book Rentals does not credit or debit my credit or debit card for a period of time due to circumstances beyond its control. Campus Book Rentals makes no guarantees regarding the processing time for charges.

In order for Campus Book Rentals to service my account or to collect any amount you may owe, you agree, unless otherwise prohibited by applicable law, that Campus Book Rentals or a designated Third Party Collection Agency are authorized to (i) contact me by telephone at the telephone number(s) in the patron contact account information I am providing, including wireless telephone numbers, which could result in charges to me, (ii) contact me by sending text messages (message and data rates may apply) or emails, using any email address I provide and/or (iii) methods of contact may include using pre-recorded/artificial voice message and/or use of an automatic dialing device, as applicable. I also agree, if my rental is eligible to be returned to Nebraska Book Company, I will still be liable for a service fee assessed by the Third Party Collection Agency. You acknowledge that you have have read this disclosure and agree that the Third Party Collection Agency may contact you as described above.

If attempts by Campus Book Rentals to charge the Replacement Cost to your card account are unsuccessful, you agree to pay Campus Book Rentals’ reasonable attorney’s fees and costs incurred to collect the Replacement Cost, whether suit be brought or not, although attorney fees and costs will not be charged to my credit or debit card account.

Campus Book Rentals agrees to keep all your personal and payment information confidential in accordance with our privacy policy.

Campus Book Rentals may assign this agreement to a parent or affiliate company at its sole discretion.

FAQ'S

1. How do I track my books?
Log in to your account by clicking here. Once inside, you'll see your current textbook rentals listed along with a yellow box that says "track". Click there to view the tracking number and track your book(s). Note: not all books will have a tracking number, but most do and tracking numbers are loaded into your account as they become available.
2. How do I return my books?
Each time you rent textbooks from Briar Cliff, you'll receive a bubble envelope with a prepaid USPS label attached to the outside. When you're done with your books, simply place them inside the return envelope and drop the package off at the nearest USPS drop box or Post Office. You may also print a return label from your online account. Both shipping methods are completely prepaid and will insure your books arrive at the correct facility.
3. Can I write or highlight in my books?
You certainly can. Just remember that future students will rent the same book after you, so try to be respectful.
4. How long will it take to get my books?
It depends on the shipping method you choose. We offer free shipping anywhere in the contiguous US which can take 7-14 business days. If you choose expedited shipping you can expect your order in about a week (5-8 business days). Remember, we offer a 21 day no-hassle money-back guarantee if you drop your class, order the wrong book, or just plain change your mind. You won't even pay for shipping.
5. Can I purchase my book after I rent it?
Yes, you can. You're only charged the difference between what you already paid to rent the book, and the value of the book at the time you initially rented. This is what makes renting textbooks so cool; it saves you money, while still allowing you to purchase the book if you'd like to. If you decide to keep a book, simply log in to your customer account, choose to purchase your book, and it will walk you through the checkout process.
6. Are there late fees?
We will do our best to make returning your book(s) simple and easy. As stated above, we even provide the return package with a prepaid label already attached. If however, books are not returned at the end of the rental period (and after the grace period), as specified in the rental agreement, the renter will be notified via email that their card will be charged for a 15 day extension of their book(s).
